April 24 CMS and the Assistant Secretary of Preparedness and Response (ASPR) released a new toolkit to help state and local healthcare decision makers maximize workforce flexibilities when confronting COVID-19 in their communities.

CMS announced new regulatory requirements that will require nursing homes to inform residents, their families and representatives of COVID-19 cases in their facilities.

April 3 CMS Provides Additional Clarification on Telehealth
Released on March 27 under the CARES Act Section 3705 provided a temporary waiver of requirement for face-to-face visits between home dialysis patients and physicians. This would allow Medicare beneficiaries determined to have end stage renal disease receiving home dialysis to choose to receive monthly end stage renal disease-related clinical assessments via telehealth. The Medicare telehealth new waivers released on March 31st modified care planning specifically in the Conditions of Coverage §494.90(b)(4) requirement which requires the ESRD dialysis facility to provide at least monthly, and periodically while the hemodialysis patient is receiving in-facility dialysis. CMS waived the requirement for a monthly in-person visit if the patient is considered stable and also recommend exercising telehealth flexibilities, e.g. phone calls, to ensure patient safety. In addition, CMS made conforming changes to the telehealth payment rules through an interim final rule issued on March 30, 2020 to allow for these flexibilities.
